He might have a rotation spot to lose in spring training, but the way he has pitched suggests he has a pretty good chance to lose it

He was charged with resisting arrest, search and transportation by using force against an officer, according to the Houston Chronicle. Backe was released on $1,500 bond.
Backe went from respectable in April (4.65 ERA) and May (4.46) to disastrous down the stretch, surrendering 44 earned runs in his final 40 innings (9.90). Stay away from the 30-year-old starter until he shows more consistency.
